The terms of an offer must be clear, unambiguous and communicated to the other party in a way that is understood by them. The offer may also include any special conditions that apply to it.
The law requires that an offer must be communicated in a way which does not mislead or deceive the recipient into thinking they have accepted it when they have not actually done so (known as ‘misrepresentation’). Acceptance must also be definite and unambiguous–that is, there should be no doubt as to what exactly was agreed upon by both parties involved in creating this agreement.
